SC permits students to make representation before authority to attend JEE Advanced 2021

The JEE
Advanced 2021 registration process has started and exam will be scheduled to be
held on October 3, 2021 by IIT Kharagpur. On Wednesday, the Supreme Court allowed students who cleared the JEE Main exam in their third attempt and are thus ineligible to appear for the JEE Advanced, to make their case before the representation authority.
The apex court disposed of writ petition filed by these eligible students. The SC said these students could make representations
before the Joint Admission Board, JEE (Advanced).

The petition
for JEE Advanced 2021 was heard by a bench consisting of Judges AM Khanwilkar,
Dinesh Maheshwari and CT Ravikumar. These students can now contact the
authorities, raise their issue of seeking accommodation for the JEE Advanced
Exam 2021 and then the authorities to
decide. The bench asked the JEE official to look into whether there was a way
to change the policy or find a way around the case.

“Accordingly,
we dispose of this writ petition with liberty to the petitioners to make
representation before the appropriate authority of respondent number two
(Chairman, Joint Admission Board), in the first place,” said the bench, also
comprising Justices Dinesh Maheshwari and C T Ravikumar

The petition
was filed challenging criterion 4 to clause 11 of the JEE Advanced 2021
Information Brochure. According to the Brochure, candidates who passed class 12
in 2019 have given rendered ineligible
appearing in JEE Advanced 2021. The petitioner allege that the law violates
Article 14 of the Indian Constitution, which deals with equality before the
Act. In addition, the complaint states that these candidates only passed class
12 in 2019 but are within the prescribed age for writing exams.

According to
the report, the Adviser went on to say that the petitioner’s attempt of appearing
in JEE Advanced 2020, should not be counted as an attempt. This is because the
situation in 2020 was not going well due to pandemic problems and lockdown.
However, the Bench clearly states that it cannot interfere with the policy of
the authorities. Therefore, allow students to submit their representation to
them and allow a competent authority to take a call.
