Ex-reality TV star Josh Duggar’s lawyers file motion to dismiss child porn case

Reality TV personality Josh Duggar‘s attornies have filed a motion to dismiss the ongoing child pornography case against him. The motion demands the dismissal of two charges including one count of receiving child pornography and one count of possessing child pornography, reported E! News.

The first motion to dismiss states that the government failed to preserve potentially exculpatory evidence while the other motion argues that the indictment should be dismissed because two of the US secretaries of the US Department of Homeland Security, who were involved in Duggar’s processing and investigation, were not properly appointed at the time.

Duggar’s legal team also filed three motions demanding the court to suppress certain evidence in the case, including all the statements made by the former reality star to the investigating officers before the latter’s phone was confiscated and before Duggar could call his attorney.

Additionally, the former reality star’s legal team has filed another motion asking the court to suppress images of Duggar’s hands and feet that were taken while he was in custody. As per Duggar’s lawyers, the Homeland Security Investigators did not have a warrant to authorise the taking of the photographs.

Joshua James Duggar, popularly known as Josh Duggar is a former reality television personality famous for his appearance in the reality series 19 Kids and Counting.

Duggar was arrested by federal agents in his Arkansas residence in April 2020. The charges against him were of downloading child pornography in 2019, including one file that depicts the sexual abuse of children whose aged from 18 months to 12 years old, said a federal agent in a recent hearing as per E! news.

According to the federal agent’s statement, the images he found on Duggar’s computer were “in the top five of the worst of the worst that he has ever had to examine.”

Duggar, now the prime accused in the child pornography case, plead not guilty and was released on bail in May. The terms of her release were that he will be monitored with a GPS anklet and won’t be allowed to access the internet.

Duggar is permitted to visit his children, but only in his wife, Anna Duggar’s presence. His trial began on July 6.
