Clarence Thomas was pivotal in delaying Congress certification of 2020 elections: Trump lawyers
- Emails from Trump's legal team show that judge Clarence Thomas was crucial in Trump's plan to stop Joe Biden from becoming president
- Trump's attorneys wanted Thomas to issue an order putting on hold the counting of Biden's Georgia votes
- They believed that a pending case would be enough to stop the Senate from counting the votes
A lawyer representing Donald Trump said that Supreme Court Justice Clarence Thomas was ‘key’ in the former president’s plan to delay certifying Joe Biden’s victory in the 2020 US elections. The revelation came through the emails accessed by the House Select Committee investigating the January 6 Capitol Hill riots.
Trump and co. conspired such that Thomas can issue a temporary order putting the Georgia election results in doubt. Accordingly, Trump’s attorney Kenneth Chesebro wrote an email on December 31, 2022, in which he said that they “wanted to frame things so that Thomas could be the one to issue” the order.

He added that the temporary order was their “only chance” to stop the counting of Biden’s vote from the state of Georgia. Another Trump attorney, John Eastman, responded to the email agreeing with the plan.
The email exchange accessed by the House Select Committee is part of the former president’s legal team’s plan to file a lawsuit putting on hold the counting of votes in Georgia over a claim of electoral fraud against Joe Biden.
Since Thomas is the justice usually dealing with emergency matters coming from the southeastern US, it would be important to have him on board with the order, as per their plan. They believed that a pending case of election fraud in front of the Supreme Court will be enough to stop the Senate from counting Biden’s votes.

District Judge David O. Carter had earlier observed that the email exchange of Trump’s legal team could have potential criminal evidence against the former president. He said that they would show that Trump was using legal means to meddle with the congressional proceedings illegally. With these observations, he ordered that the emails be released to the Committee to aid investigations.
They were released subsequently and are now available in full to the Committee.
