US Supreme Court seems set to strike down Roe vs Wade,If the leaked draft of the majority opinion by Justice Samuel Alito is to be believed, it appears that the historic Roe vs Wade ruling may be struck down. This will mean that women will lose the federal protection of a broad right to abortion and states will enact their own laws to legislate abortions. Without the protection of the Roe vs Wade ruling, abortion would immediately become illegal in 13 states, as those legislatures have already passed trigger laws that will come into effect if Roe vs Wade is struck down. Additional states are already in the process of mulling and passing laws to restrict abortion. Unless a new law is created at the federal level. In a speech on the floor of the US Senate, he said A vote on this legislation is not an abstract exercise, this is as urgent and real as it gets. He further added We will vote to protect a woman's right to choose and every American is going to see which side every senator stands. But any legislation at the federal level will face significant obstacles in the US Senate, which is currently split 50-50 between Democrats and the Republicans. The majority party, in this case the Democrats, can change the rules since they own the tie-breaking vote which will be cast by the Vice President Kamala Harris. This will change historical precedent and have implications which either party has so far shown itself to be unwilling to incur. It also requires the invocation of cloture. According to Senate Rule XXII, once the Senate invokes cloture, “then said measure, motion or other matter pending before the Senate, or the unfinished business, shall be the unfinished business to the exclusion of all other business until disposed of.” This stops work on any other legislative priorities. Cloture itself is a long drawn out process which can take a couple of weeks to invoke. With a razor-thin majority, and Democratic senators who often dissent, such as Joe Manchin and Krysten Synema, it is far from guaranteed that the filibuster will be overcome. While there are some Republicans, like senator Lisa Murkowski who say they are pro choice, it is unlikely that any Republican will join Democrats in creating legislation to codify Roe vs Wade into law. ,Where do we go from here,While US President Joe Biden in his written statement said it will fall on our nation’s elected officials at all levels of government to protect a woman’s right to choose, he also said that he is not prepared to make a judgement to remove the filibuster. In the written statement Biden called for voters to elect pro-choice officials this November. Democrats are widely expected to use this issue in the 2022 mid-terms though and are hoping that this will galvanise their base and attract independents to their fold. They might be right. According to a Pew Research Center fact sheet from 2021, 80% of Democrats and those who lean toward the Democratic Party say abortion should be legal in all or most cases. The same fact sheet also reports that 59% of all Americans say that abortion should be legal in all or most cases.
