Australia’s aboriginal flag represents the indigenous peoples of the Australian mainland. It has a special legal and political status together with the national flag.

It was first raised on July 9, 1971 and was first recognised by the Australian Government as an official ‘Flag of Australia’,under the Flags Act 1953, in 1955. In January 2022, the Commonwealth of Australia secured the copyright of the Aboriginal flag for free, public use.

Harold Thomas, an Aboriginal Australian artist, is the man behind designing and copyrighting the flag. He had designed the Australian Aboriginal Flag as a symbol of the Aboriginal land rights movement. He later asserted copyright over his design and then transferred that copyright to the Commonwealth of Australia.

“I do think people assume it is a national flag and they wonder, how can somebody can assert ownership of it?” Terri Janke, a Wuthathi/Meriam woman and intellectual property lawyer, said. 

“People get confused as to whether you are allowed to display the flag or march with the flag – you could always do those things. But the reproduction rights are what have been under question,” he added.
