Both publications filed an appeal with the supreme court, challenging the notion that publishing the image qualified as obscene and indecent.

The Supreme Court’s bench, presided over by Justices KS Radhakrishnan and AK Sikri, declared that the picture wanted to convey the message that race doesn’t matter all that much and that love triumphs over colour while also nullifying the local court’s order and all legal actions taken against the publications, according to One India.

The court’s standard was that a photograph of a nude or semi-naked woman cannot be classified as offensive in and of itself.
