The special NCB court on Wednesday denied bail to Shah Rukh Khan‘s son Aryan Khan and co-accused Arbaaz Merchant and Munmum Dhamecha in the alleged drug on cruise case. The court in its detailed order had a mention of Bollywood actor Rhea Chakraborthy and her brother Showik, who were also arrested by the agency in an alleged drug case recently.

Why were Rhea and Showik’s Chakraborthy cases mentioned in the order?

According to Hindustan Times, the court order in justified denying bail to Aryan Khan referred to additional solicitor general Anil Singh’s argument that Showik Chakraborty was also not in possession of drugs when the Narcotics Control Bureau arrested him.

Citing the Bombay High Court’s verdict that said since Showik appeared to be an important connection in the identification of the chain of drug dealers and in such cases, each of them is liable for the entire quantity of drugs seized, the NCB court said that even if no drugs were found on Aryan Khan, his case is not separate from the others who were arrested with drugs in their possession.

“He was in touch with different dealers. He had monetary transactions with them. Disclosure by each of them has led to the discovery of the involvement of others. Hence it is not desirable to release the applicant on bail at this stage,” the order said citing the high court’s past verdict regarding Showik,” HT quoted the court as saying.

The order, as per an HT report mentioned that Rhea Chakraborty’s case and said, “In the authority of Rhea Chakraborty (supra), it has been made clear that all offences under NDPS Act are non-bailable…Jurisdiction to grant bail is circumscribed by the provisions of Section 37 of the NDPS Act which can be granted in the case when there are reasonable grounds to believe that accused is not guilty of such offence and that he is not likely to commit any offence while on bail.”

Rhea and her brother were arrested in a drugs case last year. She was released on bail after 21 days. Actors, including Deepika Padukone, Sara Ali Khan, Rakul Preet and Shraddha Kapoor, were also questioned by NCB in the drugs case.
