Elon Musk is countersuing Twitter. The tech billionaire filed a lawsuit against the social media giant hours after the Chancellor of the Delaware court announced trial dates for Twitter’s case against Musk.

While the lawsuit was filed confidentially, a court-approved redacted version could soon become available to the public. The five day trial set by Chancellor Kathaleen McCormick is set to take place from October 17 to October 21. The trial will determine if Musk will be forced to buy Twitter for the price of $54.20 per share that he had promised in April. 

Early this month, the founder of Tesla announced that he was pulling the plug on the $44 billion deal to buy out Twitter. Days later, Twitter announced a lawsuit in the Delaware Court of Chancery saying that the billionaire was legally bound to closing the deal.

Last week on July 23, 2022, Chancellor McCormick announced that the trial would be held in October. Twitter had asked for the trial to be held in September while Musk’s lawyers had been eyeing a trial in February next year. Following the Chancellor’s announcement, the billionaire’s lawyers asked for a court date of October 17, to which Twitter agreed. However, the two are currently at odds over the limits of discovery and access to internal documents and evidence. 

On the one hand, Musk’s lawyers claim that Twitter is dragging their feet when it comes to handing over what it says are key pieces of evidence, as part of their discovery requests. Twitter, on the other says that the requests to hand over large amounts of data are irrelevant to the current case: determining whether Musk has violated the terms of the $44 billion contract.

The founder of SpaceX and Tesla had pulled out of the $44 billion deal alleging that Twitter had been negligent in providing adequate information on “spam bot” problem on the social media platform.
