Elon Musk‘s deposition by Twitter’s legal team has been rescheduled for October 6 and 7, according to a Reuters report.

The revised dates mean that the tech billionaire will be answering Twitter’s questions just 10 days before the October 17 trial, where Chancery Judge Kathaleen McCormick will decide whether or not Musk was justified in terminating his $44 billion buyout of the social media company.

Sources close to the ongoing litigation told Reuters on Monday said that the deposition dates were subject to change, given the fast track nature of the case.

Since Musk countersued Twitter in August, the two sides have been engaged in a battle of discovery and depositions as they prepare for the five day trial next month.

The billionaire has already been reprimanded by Judge McCormick for failing to turn in all his messages to Twitter’s team, despite being requested. The Reuters report mentions that Twitter is set to file a motion on Tuesday asking that Musk’s legal team be punished for their failure to turn over messages about his decision to terminate the deal.

In the past, Musk’s team has said that the social media company has been attacking the chief executive officer of Tesla because they want to cover up their own failings.

Last month a whistleblower came forward with explosive allegations about how Twitter. Former Twitter cybersecurity chief Peiter Zatko said that the social media company did not meet industry cybersecurity standards, was compromised by foreign agents and had been misleading regulators like the Federal Trade Commission and the Securities Exchange Commission.

Zatko received subpoenas from Musk who also included the former DARPA researcher’s accusations as an amendment to his countersuit. The 51-year-old was also asked to testify before the Senate Judiciary Committee earlier this month. 

Twitter is keen to convince Judge McCormick to force Musk to close the $44 billion deal at the agreed price of $54.20 per share.
