A couple was arrested and charged with public indecency after they were caught allegedly having sex while riding an Ohio Ferris wheel Sunday night.

The duo have been identified as David Davis and Heather Johnston, both 32. They were seen having sex inside a chair of the Giant Wheel inside the Cedar Point amusement park just after dark. Fellow riders, including some minors, spotted them in action, Sandusky police told local NBC-affiliate WKYC.

“The group said that the couple knew that they were watching and started laughing and continued their behavior,” according to the police report.

Initially, the couple denied having sex while on the ride. The woman claimed that she dropped a pack of cigarettes from the shorts and her partner was helping her to pick them up. However, they later admitted to it. The ride climbs a height of 145 feet.

The public indecency charge in Ohio include, exposing their private parts, engaging in sexual conduct or masturbation, or engaging in acts an ordinary person would consider sexual conduct or masturbation.

If a person knowingly engages in masturbation or sexual conduct (or behavior that would be considered by others as either), they could be charged with a second-degree misdemeanor. 

The class of charge increases if the person who saw the conduct was a minor. Then, a fourth-degree charge becomes a second-degree, and a third-degree becomes a first-degree.

A fourth-degree misdemeanor holds up to 30 days in prison or a fine up to $250. A third-degree is up to 60 days in jail and/or a fine of up to $500.

Someone charged with the second-degree could face up to 90 days in jail and/or a potential fine of $750, while the first-degree charge can send someone to 180 days in jail and/or up to a $1,000 fine.

The degree charge in the latest incident has not been revealed.
