David DePape, who is accused of brutally assaulting Paul Pelosi, the husband of House Speaker Nancy Pelosi, at the couple’s San Francisco home, was charged with two federal criminal charges by the Justice Department on Monday.

DePape entered the Pelosi residence early on Friday carrying zip ties, tape, rope, and at least one hammer, according to the new federal criminal complaint, and DePape “was prepared to detain and injure Speaker Pelosi.”

The complaint also claims that after Paul Pelosi informed DePape that Nancy Pelosi “would not be home for several days,” DePape “reiterated that he would wait.”

The complaint states that DePape “later explained that by breaking Nancy’s kneecaps, she would then have to be wheeled into Congress, which would show other Members of Congress there were consequences to actions.”

DePape, 42, was accused of assaulting a member of a US official’s close family with the intention of retaliating against the official for doing their official duties. He was also accused of attempting to kidnap someone. 

The San Francisco Police arrested the Richmond, California resident on Friday after discovering him at the residence fighting with Paul Pelosi, 82, over a hammer.

DePape reportedly took hold of the hammer after officials told the men to drop it and hit Pelosi in the head, knocking him out.

The Justice Department reported in a press release on Monday that police recovered a roll of tape, white rope, a second hammer, a pair of rubber and cloth gloves, and zip ties from the crime scene.

If found guilty of the federal assault allegation and the attempted kidnapping charge, DePape could spend up to 30 years in prison and 20 years in jail, respectively. These federal charges are in addition to state charges that may also be announced on Monday.

On Monday morning, Pelosi was still in the intensive care unit of a hospital in San Francisco, surrounded by family members, NBC reported citing sources.

A source with knowledge of the investigation that law enforcement agencies, including FBI agents, obtained Pelosi’s version of the house invasion on Sunday, NBC reported.

Pelosi informed police that DePape, whom he didn’t know, had come into his bedroom asking for Nancy Pelosi while he was fast asleep.

The insider claimed that Pelosi had full cognitive capacity and appeared to remember the entire affair.

Nancy Pelosi, a Democrat from California who serves as Speaker of the House and is second in line to become president, was in Washington, D.C., at the time of the attack.
