In 2021, the trial was postponed after Lori Daybell was considered unfit to stand trial. After a long period of mental assessments, she was finally declared fit to stand trial.

The trial of Lori Vallow Daybell is set to appear for trial from 3rd April 2023 at the Ada County Court in Boise, Idaho. While the prosecutors had previously filed for a death sentence if Vallow was convicted, the presiding judge favored the defense. As a result, Lori Vallow will not face the death sentence if found guilty of the murder of Tylee and JJ.

Therefore, Lori Vallow will have to testify in her trial if Chad Daybell decides to testify against her in exchange for a shorter sentence or the removal of the death penalty.
