Alec Baldwin‘s lawyer said the Federal Bureau of Investigation’s report about the actor pulling the trigger on the set of Rust is flawed. The lawyer’s response came after the FBI concluded in its latest report that cinematographer Halyna Hutchins could not have been killed on the set of the western Rust “without a pull of the trigger while the working internal components were intact and functional.”

Halyna Hutchins was an accomplished cinematographer who had worked on over 30 films, television shows, and miniseries. The Ukrainian artist was best known for her work in the 2019 film Darlin’, the 2020 film Archenemy, and the 2021 film The Mad Hatter.

Baldwin’s lawyer, Luke Nikas, spoke to Fox News on Monday, the same day Halyna Hutchins’ death was ruled an accident, and said the feds are wrong to conclude Baldwin pulled the trigger because the testing they did doesn’t show that.

“The FBI report is being misconstrued,” says Nikas. He continues, “When the hammer was pulled back and the gun broke in two places, the gun fired only once without having to pull the trigger. Because the gun was in such poor condition, the FBI was unable to fire it in any previous test, even when pulling the trigger.”

Essentially, Nikas appears to be implying that either the report’s findings are misrepresented (given that they’ve only been reviewed/reported on by ABC) or that the FBI simply misrepresented what they did in the lab to get to the bottom of this. In any case, he claims it’s nonsense.

While it was unclear from ABC’s report whether the FBI tested the old revolver in question, Nikas appears to be implying that they did. Nikas believes the FBI’s report on the gun is irrelevant in the grand scheme of things because the Santa Fe Medical Investigator’s Office came back with its own pivotal finding regarding Hutchins’s death and they have officially ruled it an accident.

Nikas states, “The medical examiner’s report, which concluded that this was a tragic accident, is critical. This is the third time that New Mexico authorities have determined that Alec Baldwin had no authority or knowledge of the allegedly dangerous conditions on the set, that he was told by the person in charge of safety on the set that the gun was ‘cold,’ and that he believed the gun was safe.”

All of these findings, both from the FBI and the medical examiner, have been forwarded to New Mexico officials for further review. The District Attorney has yet to make a decision on criminal charges.
