The family of Ashli Babbitt is reportedly filing a lawsuit against the United States Capitol Police for her alleged wrongful death during the January 6 riots, according to Mike Sington, who is associated with NBC.

The lawsuit will reportedly be worth $10 million.

According to the tweet from Sington, Babbitt “was given no warning or verbal command” before being fired upon and added that she was ambushed by the officer.

Sington wrote, “Ashli Babbitt’s family filing a $10 million wrongful death suit against US Capitol Police. Their attorney says she was ambushed by the officer who shot her, and was given no warning or verbal command.”

The identity of the officer, who had fatally shot Babbitt, has not been revealed so far by law enforcement or judicial authorities of the United States even though Aaron Babbitt, the slain woman’s husband, demanded files from an investigation into the incident, according to reports from BBC.

Babbitt, who was 35-years-old at the time, was shot in the premises of the United States Capitol building and died shortly after in a hospital. She was part of a group that breached the chambers of the United States House of Representatives while it was still in session. 

The United States Department of Justice released a statement in April this year that said “no evidence to establish beyond a reasonable doubt that the officer willfully committed a violation” after investigating the incident.

The United States Department of Justice added that it saw no evidence to suggest that the officer “did not reasonably believe that it was necessary” to respond the way he did to protect others, according to reports from BBC.

The news comes less than a day after US President Joe Biden signed a legislation that awarded four medals to officers of the Washington DC Metropolitan Police Department and US Capitol Police for defending America’s prominent legislative building on January 6, 2021.
