The parents of murdered Georgia high school footballer Elijah DeWitt have filed a lawsuit against the mall where he was killed, claiming its owners ignored serious safety risks to their son’s ultimate detriment.
DeWitt was fatally shot on October 5, 2022 outside a Dave & Buster’s in an attempted robbery outside a Sugarloaf Mills Malls in Lawrenceville, Georgia.
With full knowledge of the “dangerous and hazardous conditions,” the mall “negligently represented to its invitees that the [premises] were properly maintained and reasonably safe,” lawyers for DeWitt’s parents, Craig and Dawn, said in their case filed in the Gwinnett County State Court.
The suit named Sugarloaf Mills Limited Partnership, Simon Property Group, Universal Protection Service, the mall’s security director Jason Choy, Dave & Buster’s of Georgia and five John Does as defendants. DeWitt’s parents are seeking compensatory damages on four counts under Georgia law.

DeWitt was found in a pool of blood by his girlfriend, Bailey Reidling. Kemare Bryan and Chandler Richardson, 19, were each charged with four felonies for allegedly gunning him down.
Who is Bailey Reidling?
Baily Reidling was DeWitt’s girlfriend of nearly five years. She had gone to Dave & Buster’s for what amounted to a double date night of games and some friends. According to her statement, DeWitt kissed her on her forehead and slipped her his credit card to go get food before she and another friend, Angel, went to the bathroom.

Reidling came out looking for her boyfriend, thinking that he and another friend, Oscar, were buying tickets or playing foosball but realized they were outside and suddenly saw “everything’s red.”
DeWitt and Reidling attended Jefferson High School together for one year while he was a freshman, and she was already a senior. Reidling is a cheerleader.
Later, she went off to Georgia Southern University for two years before transferring to the University of North Georgia. She got an apartment in Athens so that she could be closer to DeWitt for his senior year of high school.
She got an opportunity to travel with him to South Carolina, North Carolina, and Washington, DC when DeWitt played on a seven-on-seven team and gained recognition from Newton.
