Aryan Khan, son of
Bollywood superstar Shah Rukh Khan, will spend another night in jail as the
Bombay High Court adjourned proceedings on his bail plea on Wednesday. The
proceedings will continue on Thursday afternoon. On Wednesday, the high court
heard arguments for the second day in the drugs-on-cruise case that led to the
arrest of Aryan Khan among several others. Thursday will be the third day of
proceedings.

Aryan Khan, 23,
was arrested on October 3 after the Narcotics Control Bureau (NCB) raided a cruise
ship off the Mumbai coast which allegedly contained drugs. On Wednesday, Aryan
Khan’s lawyer Mukul Rohatgi said his client was arrested without any drugs recovery
and use and was not given a proper reason. For the NCB, Aryan Khan is accused
number 1 in the case while his friend Arbaaz Merchant is accused number 2.

Seeking bail,
former Attorney General of India Mukul Rohatgi argued before the high court
that no person who is arrested can be held without being informed of the
grounds of arrest and such a person shall have the right to consult a lawyer of
his choice.

Rohatgi also cited
Article 22 of the Indian Constitution on protection against arrest and
detention in certain cases.

The NCB, which has
veritably opposed Aryan Khan’s bail, has made its case on the basis of WhatsApp
chats on Aryan Khan’s phone. The anti-narcotics agency has claimed that the
chats provide evidence of Khan’s involvement in “illicit drug deals” and have
also alleged the 23-year-old’s links with an international drug cartel.

Aryan Khan’s friend
Arbaaz Merchant told the court that there was no evidence of any conspiracy or
agreement on drugs between them. “It is unnecessary to show a meeting of minds.
Three unconnected people coming for the same purpose is not a conspiracy. Three
people individually deciding to consume is not a conspiracy,” Arbaaz Merchant’s
lawyer Amit Desai said.
