The bail plea of Aryan Khan will now be heard on Wednesday by a special court under the Narcotic Drugs and Psychotropic Substances (NDPS) Act in Mumbai. Lawyer Amit Desai, while arguing his case, had requested for his bail plea to be heard today. “No drugs were found on him,” the lawyer said.
“The offence involves only a one-year sentence. For this child, seven days is not suitable,” Mr Desai had said.
This comes after he was arrested on October 3 by the NCB after it raided a rave party on a Goa-bound cruise.
Aryan Khan’s lawyer said, “It is natural that if bail application is rejected by a court, we move to the higher court. We have filed the bail application here. The hearing is likely to take place today,” as per ANI report.
A local court in Mumbai denied bail to Aryan Khan and two others last Friday. Aryan Khan, Arbaaz Merchant and Munmun Dhamecha were sent to jail for two weeks by Additional chief metropolitan magistrate (ACMM) RM Nerlikar, pending an investigation into the case. They have been booked under several provisions of the NDPS act.
In his 15-page order released on Saturday, Nerlikar said, “A magistrate’s court does not have the jurisdiction to entertain a bail application for an offence with prescribed punishment of more than three years under the NDPS act and it has to be tried by a special court.”
After getting tipped-off, an NCB team raided the Goa-bound cruise ship on October 2 and claimed to have captured banned drugs aboard the cruise ship off the Mumbai coast. On Sunday, the NCB said that it has arrested a Nigerian national with links to the cruise ship drugs party raid. This takes the number of people arrested in connection with the case to 20.
An NCB official told news agency PTI that “a team laid a trap in suburban Goregaon and apprehended the accused, identified as Okaro Ouzama, along with an intermediate quantity of cocaine, on Saturday.”
