The Supreme Court on Friday will hear in the case of reservation list issued in the Uttar Pradesh Panchayat elections after a petition was filed challenging the order by the Allahabad High Court that directed Uttar Pradesh to take the base year 2015 instead of 1995 for reserving seats. 

The Allahabad High Court on March 15 quashed an order by the UP government, issued on February 11, which deals with the reservation of seats for the upcoming panchayat polls in various categories of candidates and taking the base year as 1995.

The high court’s order had also asked the state to hold elections by May 10 and indirect elections by May 25. On the other hand, the final reservation list for the UP Panchayat elections will also be issued on Friday. 

The petition, drawn by Advocate Shariq Ahmed and filed by Advocate Sunil Kumar Verma, also challenges the list issued by the UP government on March 17, under which Ishanpur constituency, Jaunpur district, which were earlier unreserved, have been marked reserved for the Other Backward Class category.

The petitioner contended that it was not brought to notice to the high court that UP Panchayat Raj (Reservation and Allotment of Seats) Rules, 1994 were amended by the 11th amendment on 9th Feb 2021, and the order was issued accordingly by the government. 

The petition also raised an objection on the reservation of women and OBCs in every district for gram panchayat. Women in the OBC quota from the reserved category get over 33% reservation while women from the unreserved category get less than the standard 33% reservation.
