After lawyers claim she was falsely accused, a mother and her 14-year-old son who were initially charged with murder in the fatal shooting of a man at a Chicago fast food restaurant earlier this month intend to file a lawsuit.

According to a statement from Hood’s attorneys, she was wrongfully detained by the Chicago Police Department on June 21, 2023, on suspicion of first-degree murder. These accusations have since been dropped. According to the press release, Hood will make her first public statement following the incident at 9 a.m. on Tuesday.

According to the announcement, “These charges have caused great harm to Ms. Hood, her family and her family’s reputation. Ms. Hood is and has always been a victim.”

The Cook County State’s Attorney’s office announced on Monday that it had examined the evidence in the case against Carlishia Hood and her son, 14, and had moved to drop all charges against them.

The agency issued a statement that said, “Based on the facts, evidence, and the law we are unable to meet our burden of proof in the prosecution of these cases.”

The announcement comes three days after Ja’mal Green, a community leader and former candidate for mayor of Chicago, shared a now-viral video on social media that included previously unreleased cell phone footage that documented the events leading up to the fatal gunshot.

Green claimed during a press conference on Monday that individuals from all around the nation commented “because it was framed differently at first.”

“We have got to stop allowing this violent behavior in our neighborhoods, period. There should never be any case where anyone is putting their hands on someone and acting violently in an establishment in any neighborhood and we should step up and say ‘enough is enough. It had to be a 14-year-old boy to save his mother. Where are we as a community if situations like this can happen and a woman can be severely attacked and no one does anything? But, in this case, this young boy did what we felt was right and I believe that the decision by the state’s attorney today was correct,” Green added.

The incident occurred earlier this month at a Maxwell Street Express on the city’s Southwest Side, and according to the police, Hood, 35, and her teenage son were charged with murder.

Police reported that while in line for lunch at the eatery at 11656 S. Halsted St., Hood and 32-year-old Jeremy Brown got into a fight. When the fight got heated, Hood allegedly texted her son to come to the restaurant.

According to authorities, Brown hit Hood in the head before Hood’s son pulled a revolver and shot Brown in the back, according to the Chicago Sun-Times.

As Brown fled the store, the youngster kept firing; the teen and his mother then followed Brown into the parking lot. According to prosecutors, Hood instructed her son to continue shooting Brown until he died.

The mother of the teenager, who allegedly instructed him to shoot Brown’s girlfriend after he stopped shooting at him, is claimed by authorities to have urged Brown to start the earlier argument. Authorities said Hood attempted to take the gun herself before her son pushed her away and the two ran away.

According to investigators, Brown ultimately passed away from his wounds.

Police revealed surveillance footage of the incident, which showed Hood ordering lunch and her son firing fire in the eatery and the parking lot before the two departed. However, additional video from inside the restaurant that is going viral on social media shows Brown punching Hood repeatedly before the shooting.

Brown is heard saying in the video, “If you say one more thing, I’m going to knock you out,” before hitting Hood.

The video of Brown hitting Hood ended with what appeared to be a gunshot.

On Wednesday, Hood and her son turned themselves in to the police and were taken into custody, according to Chicago police. Both of them were accused of first-degree murder, and Hood was also accused of aiding a minor’s delinquency.

Hood, according to the prosecution, possessed both a valid firearm owners identification card and a licence to carry a concealed weapon. Hood also had no history of criminal activity.
