On August 3, Chavez was found guilty of the murder of Peter Herrera, an El Paso County sheriff’s deputy. He was sentenced to death by a jury of nine women and three men on Wednesday. The sentencing phase of Facundo Chavez’s trial started on Monday, August 7, when family members took the witness stand. Chavez’s mother, cousin, and himself begged the jury to spare him from the death penalty.

Chavez’s mother testified before the jury that his father had been violent towards her and had once sent her there with a fractured jaw. She described how he forced her children to watch the violent acts.

Chavez was invited to speak about his early years when it was his turn to take the witness stand. Additionally, he said that giving up drugs had helped him confront what he had done to Herrera. He declared that he now appreciates the value of life and told the jury, “He (Herrera) didn’t deserve any of this. I created this nightmare, I took his life and it was too early.”

When it was time to announce the verdict, everyone was cautioned by the trial’s judge, Diane Navarrete, to restrain their emotions in the courtroom. When the verdict was announced aloud, the audience was silent. Chavez had no visible reaction to the jury’s actions.
