Singer Melissa Schuman is suing Nick Carter five years after she made a public accusation of sexual assault against him, which he has consistently denied.

In 2003, when she was 18 and he was 22, Backstreet Boy, now 43, reportedly forced oral sex on Schuman, 38, and then allegedly forced her to reciprocate. She alleges that he afterwards stole her virginity.

The D.A.’s office declined to prosecute and file charges despite the singer’s police report against Carter because the statute of limitations for the claimed incident passed in 2013. Schuman now thinks her case will be revived by a new measure that modifies the civil action statute of limitations.

The actress is therefore re-filing the case in court in the hopes that it would be successful this time. Carter filed a $2.3 million lawsuit against Schuman earlier this year and has since refuted the claims. Schuman has been attempting to extort money from him for years, according to his lawsuit. In a statement to TMZ, Liane K. Wakayama, Carter’s attorney, alleged that Schuman had been preparing a scheme to harm and discredit his client.
