Businessman Raj Kundra, who is accused in the pornographic content case, moved a bail application in a Mumbai court, saying that he was being made a scapegoat and there was not a piece of single evidence in the supplementary charge sheet that mentions that he was actively involved in the creation of alleged questionable content.

In a supplementary charge sheet, the crime branch had filed a charge sheet against Kundra and three others in the case of creation and publishing of pornographic films through other apps.

The bail plea claimed that Kundra was falsely implicated in the case. He was not named in the FIR and he has been dragged by the respondent (police), it added.

For the reasons best known to the investigating agencies, he is being made a “scapegoat”, it said.

After the charge sheet was filed, the accused approached the metropolitan court for bail and said that the investigation in the case was practically over.

Kundra, who is the husband of Bollywood actor Shilpa Shetty, was arrested July 19 in the same case. He was booked under relevant sections of the IPC and the Information Technology Act.

The bail that was filed through advocate Prashant Patil, the businessman claimed that there is no evidence against which the prosecution would connect the app ‘Hotshots’ with an offence under law.

Reportedly, the abovementioned app was used for uploading and streaming obscene content.

The plea mentioned that there is no single allegation made against Kundra in the entire supplementary charge which may connect to him being involved with ‘Hotshots’.

The bail plea said that it is the sole discretion of the individual artists to upload their contents on the app.

The contents of the complaint do not disclose any prima-facie offence against Kundra, the application said.

The investigation so far clearly shows that Kundra was not involved in any offence even in the remotest way in creating the alleged “questionable content”.

Further, he is not even related to the process of uploading or broadcasting the alleged questionable content, the bail plea added.

The court will look into the bail application on Monday.
