Bollywood actor Shilpa Shetty, her husband Raj Kundra and the director of a fitness company have been booked for cheating and other offences after a Mumbai-based businessman lodged a complaint against them for allegedly duping him of Rs 1.51 crore. The FIR was registered at Bandra police station after businessman Nitin Barai alleged that in July 2014, Kaashif Khan, the director of SFL Fitness company, along with Shetty, Kundra and others asked him to invest Rs 1.51 crore on the assurance of a profit.

The complainant claimed he was assured that the SFL Fitness company will provide him a franchise and open a gym and spa at his plot at Indraprasth, Hadpasar in Pune but the deal did not materialise. Barai alleged he was threatened when he sought his money back, according to the FIR.

Shetty, Kundra, Khan have been booked under various Indian Penal Code Sections, including 420 (cheating), 120-B (criminal conspiracy), 506 (criminal intimidation) and 34 (common intention).

Kundra was released from Arthur Road Jail in Mumbai last month after a court granted him bail in a pornography case in which he was arrested on July 19.

Kundra and co-accused Ryan Thorpe, who is also currently out on bail, are accused of creating and disseminating pornographic material through mobile apps.

46-year-old Kundra has been charged under relevant sections of the Indian Penal Code, the Information Technology Act and the Indecent Representation of Women (Prohibition) Act.

He moved a bail plea before the metropolitan magistrate court on September 18 after the Crime Branch of Mumbai police filed a supplementary 1500-page charge-sheet in the case.

Kundra’s counsel has argued that the prosecution had failed to produce any evidence till date that would connect ‘Hotshots’, an app developed by the Kundra-owned Arms Prime Pvt Ltd, with an offence under law.
