A Magistrate court in Mumbai granted bail to jailed businessman Raj Kundra in the case of a pornographic film on Monday. The bail was granted on a surety of Rs 50,000. Along with Raj Kundra, accused Ryan Thorpe, who was also Kundra’s IT head, was also granted bail by a court in Mumbai in the pornography case.

Two days back Kundra had filed a bail application in a Mumbai court, saying that he was being made a scapegoat. He further added that there was not a single piece of single evidence in the supplementary charge sheet that mentioned that he was actively involved in the creation of alleged questionable content. Raj Kundra told the Metropolitan Magistrate Court, the the videos were shot with full consent of the participants. Kundra also claimed that he owned the app Hotshots for only 10 months.

In a supplementary charge sheet, the crime branch had filed a charge sheet against Kundra and three others in the case of the creation and publishing of pornographic films through other apps.

In the 1,467 page charge sheet, the police had presented statements of people associated with Kundra, including his wife Shilpa Shetty, who was allegedly too busy with her work to be aware of what Kundra was up to.  

The bail was filed by advocate Prashant Patil. The plea said that it is the sole discretion of the individual artists to upload their content on the app – Hotshots – that was mentioned in the chargesheet. The app was reportedly used in the creation of porn.

The contents of the complaint do not disclose any prima-facie offence against Kundra, the application said.

Raj Kundra was first arrested on July 19. Kundra is currently at the Arthur Road Jail in central Mumbai, and is likely to walk out at 9:30 am on Tuesday, according to his lawyer.

Other than Kundra and Thorpe, Yash Thakur, a resident of Singapore, and Pardeep Bakshi from London had been named as accused in the charge sheet.
