The nation’s immigration law has returned to Title 8, the customary procedural guideline that was used for executing immigration law before the pandemic, as Title 42 is no longer in effect at the US border.

This proposal includes provisions for asylum, refugees, and visas, among other areas of immigration law. It also has an “expedited removal” tool for quickly deporting individuals. According to authorities, many newly arriving immigrants may expect that they will be processed and deported from the United States within a few days after Title 42 expires.

What is Title 8?

All of the United States immigration laws are found in the part of the U.S. Code known as ‘Title 8: Aliens and Nationality’. It controls issues like immigration, border security, civil rights, alien land ownership, and other issues. When Congress passes legislation on these topics, it will be included in Title 8.

Gabriel Seanez, an immigration attorney with The Law Offices of Rios, Parada & Seañez PLLC in Texas, said, “Title 8 allows the officials at the border to expedite your removal. You can come into the country at the port of entry and ask for asylum. Title 42 effectively stopped that, but Title 8 is the law of the land. It’s a federal statute, it lists requisites and prerequisites for being admissible or not admissible into the United States.”

Title 42 has permitted the U.S. Border Patrol to forbid immigrants who crossed the border unlawfully under the previous administration of President Donald Trump since COVID-19 began in March 2020.

However, the Biden administration asked the Supreme Court to abolish Title 42 in December 2020. Once Title 42 expulsions stop, U.S. authorities anticipate that 13,000 migrants will cross the southern border every day.
